The Anti-Business Implications Of Trump’s Xenophobic Privacy Policies

Amongst the controversial news of Donald Trump’s Muslim travel ban and wall with Mexico, one of the new president’s executive orders barely caused a ripple: an executive order stripping foreign citizens of some of their privacy rights.

Here is the text of the relevant executive order: “Agencies shall, to the extent consistent with applicable law, ensure that their privacy policies exclude persons who are not United States citizens or lawful permanent residents from the protections of the Privacy Act regarding personally identifiable information.”

On its face, this order is not particularly controversial, as US federal law already gives the US Government broad leeway to poke around in the personal information of non-citizens.

There may be more to this story, however, as this executive order might potentially negate the US-EU Privacy Shield agreement, a framework for allowing the personal data of Europeans to flow to US companies under certain circumstances.
