The Information We Collect

As Intellyx BV (“Intellyx”), we collect personal data of our customers and of the visitors to our websites while providing our services. Furthermore, we may receive your data from third parties. On several website pages, you will be asked to enter your personal data. Personal data we process is information that can be traced back to individuals, such as telephone numbers, e-mail addresses, business addresses or home addresses.

Intellyx takes every effort to process and store the personal data that you provide to Intellyx in such a manner that your privacy is protected and ensured. Specific laws in the Netherlands govern these conditions, as well as any disputes or claims arising from or in connection with these conditions. Intellyx is entitled to change these conditions without further notification to improve all privacy interests. Any changes will be announced on our main corporate website  (https://www.intellyx.com) immediately.

Examples of the types of personal information we may collect include:

  • Contact Information. We may collect your job title, contact information, such as your telephone number, mailing address, email address, and fax number.
  • Purchase-Related Information. We may collect purchase-related information, such as billing address, credit card number, and bank account information, as well as purchase history from you.
  • Information We Collect Automatically. For each visitor to our Web sites, our Web server automatically recognizes the visitor’s domain name, IP address, technical information about the visitor’s Web browser, and geographic information as determined by the visitor’s IP address, but no other identifiable information unless volunteered. In addition, we collect aggregate information on what Web pages visitors access or visit, including pages outside of our Web site.

Cookies and usage statistics

In addition to personal data, Intellyx uses cookies on our websites. A cookie is a small file that a server stores on your hard disk and
can only be recognized by the server that saved the cookie.

A cookie can show our server that you have returned to a particular page on a website. We use cookies and similar tools to gather information, such as your IP address (a number that is assigned to your computer when you are surfing on the Internet), and the date and the time of your visit to our websites and portal pages. This information can be used to generate statistics about the websites to assess their use anonymously and in terms of total figures. This information can also be used to optimize the websites and the solutions and services offered to customers.

Intellyx uses several types of cookies, including performance cookies, functional cookies and/or social media cookies. In such cases visitors to these websites are asked for permission to store such cookies and have the opportunity to deny use of these cookies.

Strictly necessary cookies. These cookies are necessary for our websites to function and cannot be switched off in our systems. They are usually only set in response to actions made by you which amount to a request for services, such as setting your privacy preferences, logging in or filling in forms. You can set your browser to block or alert you about these cookies, but if you do so, some parts of the site will not work. These cookies do not store any personal information.

Performance Cookies. These cookies allow us to count visits and traffic sources so we can measure and improve the performance of our site. They help us to know which pages are the most and least popular and see how visitors move around the site. All information these cookies collect is aggregated and therefore anonymous. If you do not allow these cookies, we will not know whether you are a returning visitor of our site and will not be able to monitor its performance.

Functional Cookies. These cookies enable the website to provide enhanced functionality and personalization. If you do not allow these cookies, some or all of these services may not function properly.

Social Media Cookies. Our websites may include buttons to promote web pages (“like”) or share (“tweeting”) on social networks such as Facebook and X (Twitter). These buttons work through pieces of code that come from Facebook or X itself. Cookies are placed by means of this code. We can’t influence that. Please read the privacy statement of the respective third parties (which may change regularly) to read what they do with your (personal) data they process through these cookies.

How We Use Collected Information

Intellyx uses the following personal data: name, address, phone number, and email, that we collect for:

  • Improving our Web Site. The information we collect is used to improve the content of our Web pages, to customize the content and layout of our pages for each individual visitor, and/or to notify visitors about updates to our Web site as well as marketing communications.
  • Contacting Customers about their Purchases. As part of our customer service and purchase process, individuals may be contacted by us through mail, email, and/or phone so that we may communicate with them about their order, offer customer support, request product surveys, and seek updates concerning their account profiles.
  • Special Offers and Marketing. We may also contact customers with special offers about products and services or for other marketing or promotional purposes, as well as to provide customers with information about products, services and industry trends that we think may be of interest.
  • Sharing with Third Parties. We will only share individual contact information, including email address, telephone number and postal address with third parties only when expressly stated at the time we collect such information, such as when you register to download a sponsored item. In those instances, the sponsors of the item may contact you for marketing and promotional purposes.

Certain information such as your password and payment information is never disclosed in any form whatsoever to any outside party, with the exception of providers who handle our payments and event registrations, or as required by law.

AGGREGATION OF INFORMATION

Intellyx uses information about your usage of our websites, products and services to manage performance and availability of our services and improve our products. Information that is used for these purposes is always anonymized and aggregated across multiple user accounts.

Postal Communications

If you volunteer a postal address we may send you mailings with information about new products, services, or upcoming events. If you do not wish to receive mailings from us, please let us know by sending us an email at info@Intellyx.com, calling us at the telephone number, or writing to us at the address below. It will take up to 8 weeks to process your do-not-mail request. Please note that, in the meantime, you may receive additional communications from us while we are processing your request.

Telephone Communications

If you volunteer a telephone number you may receive periodic telephone calls about new products, services, and/or upcoming events from us. If you do not wish to receive telephone calls from us or do not want us to share your contact information with other companies, please let us know by sending an email at info@Intellyx.com, calling us at the telephone number below, or writing to us at the address below. It may take up to 30 days for us to process your do-not-call request. Please note that, in the meantime, you may receive additional communications from us while we are processing your request.

Fax Communications

It is Intellyx policy not to send faxes unless specifically requested by you.

SHARING YOUR PERSONAL INFORMATION

We do not share your personal data with third parties unless one of the following circumstances applies.

With your explicit consent. We may share your personal data with third parties when we have your explicit consent to do so. You have the right to withdraw this consent at all times.

For external processing by third parties engaged by us. We will (see also above)  provide your personal data to our subsidiaries or other trusted businesses or persons to process it for us, based on our instructions and in accordance with our privacy policy and any other appropriate obligations of confidentiality and security measures. Third parties engaged by us are suppliers supporting marketing activities of Intellyx.

For legal reasons. We may share your personal data with third parties if we have a good-faith belief that access to and use of the personal data is reasonably necessary to (i) meet any applicable law, regulation, and/or court order; (ii) detect, prevent, or otherwise address fraud, security or technical issues; and/or iii) protect the interests, properties or safety of Intellyx, our users or the public in accordance with the law.

ACCESS, RECTIFICATION AND DELETING AND RIGHT TO OBJECT

Intellyx offers you access to the personal data we process. This means you can contact us asking us to inform you about your personal data that we have collected and processed and the purposes such data are used for. If you believe we are holding inaccurate personal data, please contact us so we can correct the data.

All individuals whose email addresses are on the Intellyx mailing list may view or correct their personal information stored in that list by reregistering for the Cortex and Brain Candy newsletters, clicking the “update contact information” link that will be presented, and following the instructions in the email that the Web site will send you.

Upon request, we will provide an individual with access to identifying information that we have collected about him or her (provided that they have given proof of identity). This information can be requested by sending us an email through the email link provided below or writing to us at the below address.

You may also ask us to delete your personal data from our systems. We will comply with such requests unless we have a legitimate ground to not delete the data. After the data have been deleted, we may not immediately be able to delete all residual copies from our active server backup systems. We may reject requests that are unreasonably repetitive, require disproportionate technical efforts or have disproportionate technical consequences, risk the privacy of others, or would be impractical.

You may object to certain use of your personal data if such data are processed for other purposes than necessary for the performance of our services or for compliance with a legal obligation. You may also object to any further processing of your personal data after withdrawing prior given consent, or if you opt-out for marketing e-mails. If you object to the further processing of your personal data, this may lead to fewer possibilities to use our websites and other services.

How do we store your personal information?

We store personal information at Zoho (our email service provider), our web site, as well as backup copies on our laptops. Personal information that we store is subject to security and access controls, including username and password authentication.

STORAGE PERIOD

Intellyx does not store your personal data longer than is legally permitted and necessary for the purposes for which the data were collected. The storage period depends on the nature of the information and the purposes of processing. The maximum period may therefore vary per use.

Via our internal policies, storage periods are set as follows:

  •     Contract administration: in general 7 to 10 years depending on the applicable civil and fiscal laws);
  •     Presales and marketing: as long as reasonably required for the contact with prospects;
  •     HR: in general 1 year (application information) to 2 years following end of employment (information on staff), depending on the applicable civil and fiscal laws.

Security

Intellyx takes information security very seriously. We have in place reasonable physical, administrative, and technical safeguards designed to protect your information from unauthorized use. For example, when you submit sensitive information, such as credit card or payment information, via our Web sites, the information is protected both online and offline. Intellyx uses third-party payment providers that have passed required PCI-DSS compliance rules to handle any online payments. When our registration or subscription form asks for a credit card number, that information is encrypted and protected in transit with industry-standard encryption software. We never store your credit card information, and we do not accept credit card numbers via print, fax, or email. If you wish to conduct a credit card transaction with us manually, we will do so by phone.

Despite these precautions, no data security safeguards are foolproof. Unauthorized individuals may find ways to obtain information about you from us. Although this is unlikely, if we learn that such information was obtained without authorization and there is a risk of fraud or identity theft, we will take steps to mitigate any potential harm as required by law.

If at any point we decide to use the personal information you submitted under this current policy in a way that differs materially from the privacy policy that applied at the time of that submission, you will be notified and given the opportunity via the Web site, email or in writing to opt out or otherwise prevent such usage.

Email/Anti-Spam Policy

Intellyx maintains an opt-in email mailing list. We may place your email address on this list via the following methods:

  • You may register for our newsletter on our Web site. Your email address is confirmed via a double opt-in process.
  • You may opt in to receive our newsletter when you download the Agile Digital Transformation poster.
  • You may purchase a product or service from us.
  • You may download content from our Web site where we ask you to register in order to receive the content.
  • You provide your business card or other physical medium containing your email address to an Intellyx representative in person, where that representative obtained your permission to add your name to the Intellyx mailing list by informing you that they were going to add your name to the list unless you indicated on your card or other medium that you wished to opt out of such communications.
  • You opted in to receiving emails from Jason Bloomberg in the past via one of the methods above.

Intellyx may send you bulk commercial emails if your email address has been placed on our list via one of the above methods and you have not opted out of such emails.

When you download the Agile Digital Transformation Roadmap Poster, you may opt to give us permission to provide your email address and other contact information to the sponsors of the poster. Those sponsors may contact you directly or add your email address to any list that provides for an opt-out capability. Other than for this express opt-in on your behalf, Intellyx will never sell, rent, or give away all or part of its email mailing list, unless expressly stated on the subscription page. However, Intellyx reserves the right to send emails to this list on behalf of its customers.

Once you opt to give us permission to provide your email address and other contact information to the sponsors of the poster, Intellyx is no longer responsible for any communications those sponsors might conduct with you.

You may opt out of receiving bulk commercial email from us by using the opt-out mechanism located within a received email message, by clicking the “subscribe” link on our Web site and changing your email preferences on the resulting page to indicate you are opting out, or by emailing info@intellyx.com, calling us at the below telephone number, or writing to us at the below address.

It may take up to ten (10) business days for us to process your email opt-out request. Please note that, in the meantime, you may receive additional communications from us while we are processing your request.

Complaints or Manual Email Opt-Outs
